Taking action after negligence leads to loved one’s death

On Behalf of | Oct 19, 2015 | Wrongful Death |

It is said that actions speak louder than words, but perhaps inaction can send a similarly strong message. For instance, if you have recently lost a loved one due to someone else’s failure to engage in safe, responsible behaviors, you may have grounds for a negligence claim. In other words, you may be able to take legal action against another party who failed to take appropriate action.

This can certainly be a difficult decision. Pursuing a legal claim takes time and energy and can require people to have a firm understanding of the wrongful death laws in Georgia. This can make people hesitant to pursue a lawsuit. However, failure to take action against the party responsible for your loved one’s death may send a stronger message than you think.

For example, let’s consider a situation in which someone is killed in a car accident after the brakes fail in the vehicle. The victim’s family would likely consider a wrongful death claim and may very well have grounds to do so. But if they decide not to pursue one for any number of reasons, the tragic accident may seem to just go away for everyone besides the family.

On the other hand, if the family members do decide to file a claim, the incident goes on record. The filing of a lawsuit can prompt thorough investigations, collection of evidence and testimony that may even show widespread issues with the safety of other vehicles. This can lead to significant settlements for other victims, recalls to prevent future accidents and the legal acknowledgment of what caused the death of a loved one.

Again, it can be an overwhelming situation, especially when you are still grieving a devastating loss. However, taking steps to act on behalf of your loved one by speaking with an attorney at our firm can send a powerful message that those responsible for a wrongful death will be held accountable.
