Tort Reform limit options for some Texans
Texas has some of the most drastic and stringent “tort reform” laws in the country for medical negligence claims. The justification for passing them was to “protect patients” by making Texas more attractive to doctors. The laws have done nothing to bring more doctors in. They are now just able to get away with their mistakes because the laws prevent families of severely injured patients from getting legal help to pursue claims which have been curtailed.
Congressman Bruce Braley of Iowa in opposition to bill H.R. 5
Here is a statement on the floor of the House of Representatives from Congressman Bruce Braley of Iowa, in opposition to a bill by the Republicans, H.R. 5 which seeks to impose a $250,000 cap on damages for the most injured victims of medical carelessness. It is as great a defense of the right to trial by jury and the danger to that right by imposing caps on damages as you will ever hear.
Doctors’ periodical interviews Richard Mitchell about a recent medical neglience victory
After another recent court victory in a medical negligence case, even the doctors’ periodicals are interviewing Richard Mitchell and quoting him.
Victory for a Deserving Client
Richard Mitchell obtained a $293,000 jury verdict in Forsyth County, a county not known for being plaintiff-friendly, for a deserving client whose doctor clipped and cut the common bile duct during a laparoscopic gall bladder surgery.
John Stossel – Hypocrisy Personified
John Stossel hates personal injury lawyers so much he can’t stop writing and talking about them. He claims they are his mortal enemies. He claims they are parasites. He will be doing another rant against lawyers who help injured people on his Fox show this week. For the 12 people who might watch, consider this.
When Stossel was “hurt” by a wrestler with “fake” moves, what did he do? He hired a lawyer and sued, not only the wrestler, but the wrestler’s “deep pockets” employer, the World Wrestling Federation, and settled his case for $425,000.
John Stossel is a hypocrite and some might even say a parasite himself.
Hot Coffee The Movie-the real story of the McDonald’s coffee case
The McDonald’s coffee case has been used for years by so-called “tort reformers” to justify stripping away the average citizen’s Seventh Amendment right to a jury trial. Do you think you know the facts of the case? Do you want to see how those facts have been twisted, distorted and used as propaganda to protect corporations and insurance companies from paying just compensation to innocent, injured people. The Atlanta Film Festival is showing a documentary called “Hot Coffee The Movie” which I encourage you to see. Judge for yourself whether this case is really an example of “jackpot justice” or a case of real negligence with horrible damages that justified the outcome. And I’ll bet you have no idea what the final outcome was if all you know is what you’ve seen in the media. Atlanta Film Festival on May 4th or May 6th If you can’t attend either showing the film will be available on HBO in late May as part of its summer documentary series.
The Myths of Federal Tort Reform
A conservative blogger shows why federal “tort reform” is based on myths and will destroy the Seventh Amendment right to a jury trial.
