Tort Reform limit options for some Texans

Texas has some of the most drastic and stringent “tort reform” laws in the country for medical negligence claims. The justification for passing them was to “protect patients” by making Texas more attractive to doctors. The laws have done nothing to bring more doctors in. They are now just able to get away with their mistakes because the laws prevent families of severely injured patients from getting legal help to pursue claims which have been curtailed.

Here is a statement on the floor of the House of Representatives from Congressman Bruce Braley of Iowa, in opposition to a bill by the Republicans, H.R. 5 which seeks to impose a $250,000 cap on damages for the most injured victims of medical carelessness. It is as great a defense of the right to trial by jury and the danger to that right by imposing caps on damages as you will ever hear.
