  • Mediation: In mediation, a neutral third party serves as a mediator and attempts to help the parties reach a resolution on their own.   • Arbitration: Arbitration involves an impartial third party (the arbitrator) who hears each side's argument and then issues a ruling. This ruling may or may not be binding, depending on the terms of the arbitration. Arbitration is becoming increasingly prevalent in the commercial context, and many contracts require the use of arbitration before a case may be heard in court.
